If you are a registered user, Academyket may collect and process cookie identifiers and data you provide upon registration, including your first name, last name, email, phone number, Skype ID (if applicable), time zone, interface language, IP address, and device type.

4.     Fulfillment of contracts with Academyket Business customers and reporting on language learning progress and assessment results.

5.     User session control and fraud prevention, ensuring appropriate protection of personal data.

6.     Tutor verification and the development of high-quality learning programs.

Academyket collects and processes personal data that you submit during registration and while editing your account settings. For registration, you provide your login credentials (username and password), first name, last name, and email. You can edit your account at any time, including adding information and syncing your Google and Academyket Calendars. This additional information may help you find suitable time slots with tutors or enhance your schedule visibility. However, you are not required to provide any additional information not specifically necessary for registration; this choice is entirely yours.

28. (2) Account for Tutors
Academyket collects and processes personal data submitted during your registration and profile editing. For registration, you provide your login credentials (username and password), first name, last name, and email. You are also required to provide proof of qualifications, such as copies of diplomas and/or certificates. You can edit your profile at any time, including adding information and syncing your Google and Academyket Calendars. Additional information may help you find suitable time slots with students or enhance your schedule visibility, but providing extra data—such as zip code, country, language skills, and work experience—is optional.

29. Some personal data, such as user names and locations, may be publicly visible to other users or on the web. We may implement features that allow you to control what information is made public by adjusting your privacy settings in the “Edit My Profile” section.

30. (3) Subscription to the Academyket Blog
You may choose to subscribe to the Academyket Blog to receive newsletters and updates. To do this, you will need to provide your email.

31. (4) Posting of Information
We process personal data that you voluntarily submit on Academyket, such as responses to surveys, online forms, or comments in the Q&A section of our website. By sharing information through the Services, you acknowledge that this data will be available to Academyket and other users (students/tutors). Note that some content may not be deleted if it is connected to lessons created by you and used by other users. Unless you opt out, we retain this information as necessary for resolving disputes, providing customer support, and troubleshooting, as permitted by law. We reserve the right to terminate accounts of users who violate our Terms of Service.

32. (5) Service Use, Cookies, and Other Similar Technologies
When you use our Services, we monitor and analyze web traffic and track your behavior. Please refer to our Cookie Policy for further details regarding our use of cookies and similar technologies.

33. (6) Billing Information
We process transaction details related to your activities on the Academyket Platform, including transaction ID, date, and time.

34. (7) Academyket Business
We may collect your name, email, company name, and phone number to provide information regarding Academyket Business Services, as defined in our Academyket Business Terms.

Unless you expressly consent, Academyket does not process your sensitive data.

We maintain official Academyket pages on social networks such as Facebook, TikTok, Instagram, and LinkedIn. 37. (10) Tutors Community (for Tutors Only)
We maintain a Tutors Community accessible via our website through Single Sign-On (SSO). To fulfill the purposes specified in subsection (10) of section (4) of this Privacy Policy, we will also collect and process your interaction and usage data within the Tutors Community.

38. (11) Tutors Academy (for Tutors Only)
By registering as a tutor, you gain access to our Tutors Academy, where you can take courses to enhance your skills and improve your methodology. We will collect and process your activity data, comments, reviews, and survey results to optimize our courses and enhance their engagement and effectiveness.

39. (12) Information Required for Submitting Tax Documentation
To comply with applicable tax and accounting legislation, we may need to submit various tax documentation containing your personal data, such as federal tax form 1099 or other required forms. For this purpose, we may process your full name, country of citizenship, permanent residence address, mailing address, date of birth, U.S. taxpayer identification number, or foreign tax identification number. The Directive (EU) 2021/514 (DAC7) requires us to collect, verify, and report data on reportable sellers (i.e., tutors subject to DAC7) conducting activities through the Academyket Platform. To comply with our reporting obligations under DAC7, we may process your first name, last name, primary address, date of birth, tax identification number (TIN), VAT number, and financial account identifier (e.g., bank account).

40. (13) Information Required for Marketing and Promotion
We may collect your postal address to promote the tutoring services you provide through the Academyket Platform and help you reach prospective students in your geographical area.

41. (14) Analysis of Speech Activity
During lessons on the Academyket Platform, we may analyze microphone activity and sound volume to provide you with feedback on your speaking activity. Please note that we do not record your voice or the content of your conversations for this analysis. If you are in a country within the European Economic Area (EEA) or Switzerland, you will have the option to disable this feature, as the processing is based on our legitimate interest.

42. (15) Language Assessment
We process your personal data to assess your language proficiency level. For this purpose, we may additionally process your name, email address, and assessment results, which may occur before or after your registration on the Academyket Platform.

43. (16) Video Lessons, Sales Calls, Events, and Webinars
We may process your voice recordings, lesson recordings, likeness, and interactions in videos during group classes or individual lessons, sales calls, or webinars and events. We will not record you without prior notice and your consent when required.

44. (17) Information Processed by AI-Powered Tools
We integrate AI-powered tools from third parties to enhance your experience on the Academyket Platform and for AI data training purposes. With your consent, we may use your text prompts and voice recordings to provide personalized learning recommendations, generate lesson plans, offer grammar explanations, enrich vocabulary cards, suggest exercises and homework, assess language proficiency, and enable chatbot functionality for vocabulary practice and grammar inquiries.

45. (18) Tutor Verification (for Tutors Only)
We process your facial biometrics (via a third-party online verification provider) and your ID to verify your identity and prevent fraud.

46. 4. Data We Collect: Purposes

47. We may process the personal data you voluntarily provide for the purposes defined below. Our primary goal is to personalize your experience on Academyket and deliver high-quality services in accordance with our Terms of Service.

48. (1) Provision of Services
We primarily process your personal data to authorize access to our Services and fulfill our obligations under the Terms of Service. This includes using your data during registration to help other users (tutors or students) find your account, schedule lessons, and track your learning progress. To use the Services, you must provide payment information (e.g., credit card details) through our secure third-party payment providers. For companies using Academyket Business Services, we process personal data of authorized users to create accounts, enable access, and provide language assessments and progress reports. Please note that without the information you provide under our Terms of Service, we cannot connect you with other users or facilitate lessons.

49. (2) Payment Services
We utilize third-party payment providers to securely process your payments. Your balance for lessons is safely stored using an integrated iframe from providers like Braintree, Stripe, and PayPal. All transactions are secured with SSL encryption. We do not store your payment information on our servers. We may also use transaction data from these providers to confirm purchases or verify eligibility for promotional offers.

50. (3) Referral Programs
For our "Tell-A-Friend" referral program, we generate a personalized referral link for you to share with friends. We do not collect your friends’ personal data until they access the Academyket Platform via your link. In our B2B referral program, you can share the names, job positions, and emails of colleagues who might be interested in Academyket Business Services. We will inform them that we received their personal data during our initial contact.

51. (4) Communications
We may contact you via email and other channels for service-related purposes, including welcome letters, security notices, announcements, updates, and reminders. You may also use Academyket to communicate with other users, exchange messages, conduct video calls, and leave feedback. Additionally, you may receive push notifications through the Academyket mobile app, which you can adjust in your smartphone settings. You can opt out of communications at any time, except for legal notices and essential reminders.

52. (5) User Research
Your contact data (including email and phone number) may be used to gather feedback. We may invite you to participate in research aimed at improving user experience. This research is for internal purposes only and may include feature development, marketing activities, customer support updates, and service improvements. 
Your feedback will not be recorded without your consent.

53. (6) Marketing and Promotion of Academyket
We may process your first name, last name, and email for our mailing list and newsletter, sending you commercial or promotional information about our Services. Your consent will be requested, and you can opt out at any time through the links in our messages or your user settings. If you provide your phone number, we may also contact you with promotional information.

54. To promote Academyket through blogs and influencer channels, we allow participation in our affiliate program, processing relevant information to register and track your progress as an affiliate. We may also use your postal address, with your consent, for search engine marketing. Additionally, feedback you provide may be used by Academyket without additional compensation to you, as specified in Section 12 of the Terms of Service.

We may share your email address with Google and Meta for personalized advertising and engage in behavioral and social media marketing based on our legitimate interest, while considering your privacy.

56. (8) Identifying Influencers for Potential Collaborations
We may use third-party services like Captiv8, Inc. and LiveRamp Holdings, Inc. to analyze your registration information and identify influential students for potential collaborations. If identified as an influencer, we will provide a privacy notice explaining this processing activity.

57. (9) Analytics and Development
To enhance the Academyket Platform, we monitor and analyze your personal data, including registration details, web traffic, cookies, and usage data (e.g., areas of the platform visited, visit duration, and device type). We use services like Google Analytics for Firebase and Hotjar, ensuring compliance with privacy commitments. We may conduct A/B tests to assess user engagement and satisfaction with features, and we may carry out polls and surveys using GDPR-compliant services. Participation is optional, and you can opt out of surveys through user settings.

58. (10) Tutor Verification and Program Preparation
To maintain high-quality lessons, we collect and process tutor credentials to verify their eligibility. We also assist tutors in developing learning programs. For verification and fraud prevention, we process biometric information and IDs, and we may analyze registration data to improve the verification process.

We process email, interaction, and usage data of tutors in the Tutors Community to foster collaboration, share best practices, and provide up-to-date information. Access to personal data submitted in the Tutors Community is limited to service providers and employees on a need-to-know basis.

In the event of disputes or issues related to Academyket Services, we may use data, including communications, to resolve matters, monitor user behavior, and respond to complaints or requests.

63. (14) Events and Webinars Conducted by Academyket
We collect personal data from you when you register for or attend our events or webinars. This data is used to grant access, send registration confirmations, reminders, and any materials related to the event or requested information about our Services.

64. (15) Competitions and Sweepstakes

1.    Competitions: Occasionally, we conduct learning-focused competitions. Participants must fill out registration forms to prove eligibility. We process this information to organize the competition, determine winners, and contact them about results and prizes.

2.    Sweepstakes: We also conduct sweepstakes among registered users who meet specific criteria. We process your user ID, name, date of birth, country of residence, and email address to manage the sweepstakes, verify eligibility, contact winners, and comply with legal requirements. Winners must submit an affidavit of eligibility and relevant tax forms. With your consent, we may also publish the names of winners on our website.

When sharing your data, we ensure its protection by using certified services and products and signing data processing agreements with our contractors and partners.

  • 6. How Long Will Personal Data Be Processed and Stored by Academyket?

In this case, or if you decide to delete your account, we will remove your personal data from our active systems and servers within 90 days or sooner.

  • At Academyket, we prioritize the privacy of children. Our Services are not intended for individuals under 18 years of age unless supervised by a parent or legal guardian. If you are between 13 and 18, please have your parent or guardian set up your account.

Parents and guardians are encouraged to monitor their children's internet usage and ensure they do not provide personal information on the Academyket Platform without permission.

  • (1) Participation in the Data Privacy Framework Program
  • Academyket, Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF). We have certified our adherence to these frameworks with the U.S. Department of Commerce. In case of conflicts between this Privacy Policy and the DPF Principles, the Principles will govern.   • (2) DPF Principles-Related Complaints
